Impound insurance when convictions are pending

A pending allegation is not the same as a conviction, but it can still be information an insurer asks for. Answer the question actually put to you and explain the seizure openly.

Why the new event matters

The incident that led to seizure may not yet appear on the driving licence. That does not make it irrelevant to a new quotation. Insurers can ask about pending prosecutions, fixed penalties, incidents, cancellations and the reason a vehicle is in a pound.

Published police guidance also warns applicants to declare relevant pending convictions when cover is taken out after seizure. The safest approach is to describe what has happened without predicting the outcome.

Use accurate, neutral wording

Have the seizure notice in front of you. Give the date, alleged reason and any reference. If you dispute the allegation, say that it is disputed rather than stating that it never occurred. Do not call a pending matter a conviction, and do not omit it because no court date has arrived.

If you are unsure what a form question covers, ask the provider to explain. Keep a note of the question and your answer.

Existing convictions and licence details

Check the current licence record and provide the correct offence codes, dates and points where requested. Mention disqualification, revocation or a medical restriction if relevant. A policy cannot override a lack of legal entitlement to drive.

Names, address, occupation, claims and vehicle use also matter. Concentrating on the seizure must not lead to rushed or approximate answers elsewhere in the quotation.

Correct mistakes promptly

Read the statement of fact, certificate and schedule as soon as they arrive. If a pending matter, keeper detail or use has been recorded incorrectly, contact the provider before presenting the papers. Never edit the document yourself.

Ask for a corrected copy and keep the call reference. Pound staff may verify cover and can refuse release if important facts appear inconsistent.

Information to have ready

Prepare:

  • the seizure date and stated reason;
  • notice and police references;
  • current licence and conviction details;
  • any fixed-penalty or court correspondence;
  • claims and incident history requested;
  • the roles of owner, keeper, collector and driver.

A quotation adviser can discuss insurance eligibility, not defend the motoring allegation. Keep response dates for police or court papers separate and seek legal advice where the charge or consequences are disputed.

How to answer when the outcome is unknown

Use the language from the notice or correspondence and distinguish clearly between:

  • an allegation;
  • a fixed penalty offered or accepted;
  • points already endorsed;
  • a court case awaiting hearing;
  • a conviction and sentence;
  • a matter being appealed.

Do not guess an offence code if none has been given. Tell the adviser what document you have and read the relevant wording. If the online form does not allow a clear answer, use the telephone service and ask how the firm wants the matter recorded.

The insurer may also ask why previous cover was absent, cancelled or considered invalid. Give dates and facts rather than blaming another person without evidence. If an existing insurer says its policy was valid, ask for written confirmation and keep it with the separate file dealing with the roadside allegation.

A material inaccuracy can matter even when it was accidental. Review the proposal or statement of fact carefully, including occupation, address, annual mileage and who keeps the car overnight. Correcting a mistake before collection is usually simpler than explaining it during a pound verification call.

After release, update the insurer if the pending matter becomes a conviction or the licence changes and the policy requires notification. Read the notification condition rather than waiting for renewal by assumption. For court deadlines or defence advice, speak to a suitably qualified legal adviser.

Keep the quotation documents after the policy begins. If a pound query arises, you need the certificate, statement of fact and provider contact rather than a bank-payment screenshot. When the legal matter is resolved, compare the result with what was disclosed. If anything has changed, ask the insurer when it must be reported and keep its answer with the policy papers.
